1. GOOGLE PLAY AGE SIGNALS API INTEGRATION

Google Play Age Signals API has been integrated into the Google Play version of the Licensed Application in response to emerging legal requirements that obligate developers to implement methods to verify information ("Google Play Age Signal", "Age Validation Signal") on applications distributed through App Storefronts (digital storefronts that host and distribute applications) before application access can be granted. 

To ensure compliance with regional regulations, a Google Play Age Signal check must be performed where our Licensed Application communicates locally between the Google Play Services application pre-installed on Your Device. 

We are committed to ensuring transparency for all Users; we do not have access to any Google Play Age Signals information or data generated through the Google Play Age Signals API.

We do not run, maintain, or route traffic through our own backend servers. Any external network data processed during Google Play Age Signal verification is handled entirely by Google Play and is strictly governed by the Google Privacy Policy. We do not track or receive records of this network traffic.

Google Play Age Signals are only available for regions where applicable laws require age verification before accessing an application. Users in regions without such requirements are not subject to age-based access restrictions.

1.1 NETWORK REQUIREMENTS FOR GOOGLE PLAY AGE SIGNALS API

The version of our Licensed Application available through the Google Play platform is designed to function as an offline experience; however, the local Google Play Services system framework requires an active internet connection (Wi-Fi or cellular data) to generate a Google Play Age Signal upon each launch of the Licensed Application. 

For a high-level overview of how the API networking requirements function within our Licensed Application, please read the below bullet points:

1. When our Licensed Application launches, Google Play Services on Your Device connects to Google’s secure account servers to refresh Your account's regional eligibility status and age "bucket".

2. If Your Device is offline or in airplane mode during a session launch, Google Play Services cannot verify the Google Play Age Signal status, which may temporarily restrict access until a connection is established.

   • If Your Device is offline or in airplane mode during a session launch, a message will display as follows: "Unable to verify age. Please check your connection.". 

3. If Your Google Account used on the Google Play Store to download our Licensed Application has restrictions set up in Google Parental Controls that will prevent access to our Licensed Application, attempting to launch the Licensed Application will result in the following message: "Access denied by parental control". 

   • This restricted access cannot be bypassed without the parental control settings being changed to allow access for the User.

4. If parental control settings are awaiting permissions, a message will display as follows: "Waiting for parental approval to access this app".

5. If the User's age "bucket" is under the age of 13, access will be restricted and a message will display as follows: "This app is not available for users under 13".

6. If there are no restrictions, no message will display and the Licensed Application will launch fully.

7. Each instance of launching the Licensed Application will require this Age Validation Signal.

8. Following the launch check for the Google Play Age Signal, when the Licensed Application launches for that session, Your Device does not require an active internet connection to proceed to use the Licensed Application.

2. INFORMATION COLLECTED

The Licensed Application does not access, collect, store, or transmit any personal or sensitive information.

The data accessed by the Licensed Application include the following:

1. Device Real Time Clock: References the current time of the Device

This is used solely to:

• Generate a Real Time clock HUD within the Licensed Application

• Enable certain events 

This access is required in order for the Licensed Application to function properly. This access cannot be turned off in the Licensed Application settings. 

You may refuse the access of Your Device time by ceasing further storage of the Licensed Application. 

2. Device Storage Access: Request permission to read from and write to Your Device's local storage 

This is used solely to:

• Save Game progress

• Load saved data 

• Store necessary Licensed Application files to ensure the Licensed Application runs properly

• Import or Export save files

• Access the Device file explorer to Import or Export save files

• (For PC Windows version) Creates and deletes temporary Licensed Application files on Your Device required for the Game Launcher and Licensed Application  to function properly

• (For Mobile Android version) Creates a new folder under Downloads > JJC_saves to manage, export, and import save data

3. For Mobile Android version available on the Google Play Store

• The Google Play Age Signals API for age verification in regions where applicable law requires age verification for User access. This data is not monitored, stored, or accessed by us. 

• Device internet connectivity access is required in order to validate the Google Play Age Signal check upon launching the Licensed Application.

The Licensed Application does not access, store, or transmit any files, media, or personal data or information from Your Device to us.

2.1 STORAGE ACCESS | MOBILE

The Mobile Android version of the Licensed Application may request access to local Device "files and media", this is to request and confirm access to local storage as game save data is stored under the "Downloads" folder. This feature is integral to managing save data, including importing save data between Licensed Application updates and exporting save data for User backup and import purposes. No additional local Device data or information is transmitted to us, nor is it stored or monitored by the Licensed Application.

2.2 STORAGE SETTINGS | GENERAL

You may limit or refuse storage access through Your Device settings, which may impact Licensed Application performance or save data management. The User is liable for any performance or save data issues that may arise from any necessary Device permission settings being restricted by the User.

The storage of Your local save data is Your responsibility to maintain and create back-ups for. Back-up data You create is governed under the terms of the EULA and applicable intellectual property law. You may not share, sell, transmit, or distribute save data or back-ups of Your save data in any format. The Licensed Application does not implement any "Cloud" technology. We are not liable for any data loss as a result of device or software malfunction, damage, User error, theft, or loss. 

You do not need to create or use an account with SHARP SET or within the Licensed Application in order to download, store, or use the Licensed Application. 

3. GAME LAUNCHER

The Personal Computer version (Windows) of the Licensed Application is packaged with a game launcher program required to start and manage the Licensed Application ("(the) Launcher", "Launcher", "Game Launcher"). By using the Game Launcher for the Licensed Application, You acknowledge and agree to the following:

1.  The Launcher does not use any online functionality under normal operating conditions. 

2.  Online functionality is limited to embedded links to our product pages and website ("itch.io", "SHARP-SET.com"), optional Launcher functions to check for Launcher updates, and potential prompts for installing .NET in case of issues or errors with the .NET bundled Launcher executable file. 

3.  The Launcher may attempt to connect to the internet if your system is missing a required version of the Microsoft .NET Framework necessary to run the game. In this case, the Launcher may prompt You with the option to download and install the appropriate .NET component. You may deny the installation and additionally choose to install the .NET Framework included version of the Licensed Application instead from the download page for the Licensed Application, so long as it is available for download. 

4.  The prompt to install .NET Framework does not itself collect, send, or transmit any personal or device data to us or to third parties. However, if You choose to follow the link provided in the prompt to download .NET from an external website (such as Microsoft's official site), that website may collect data in accordance with its own privacy policy. We do not control and are not responsible for any data collection or processing that occurs on external sites.

5.  The Launcher creates new folders as well as temporary files solely for gameplay purposes and accesses Your local file system only for storage and game operation.

6.  The Launcher creates new folders and files under Users > UserName > Documents > JJC_Saves > saveImports and saveExports. These folders are used to manage save data. These folders are integral to the function of the Launcher and the Licensed Application. Altering, moving, copying, or removing these folders or files in any way not illustrated by the "Game Launcher Instructions" or the "Game Launcher Instructions - framework" PDF included in the Licensed Application download may interfere with the functionality of the Launcher and the Licensed Application and could cause various issues such as loss of save data, among other issues. 

7.  The Launcher creates and deletes new temporary folders and files under Users > UserName > AppData > Local > Temp to enable essential functions of the Launcher and the Licensed Application, such as running the Launcher and the Licensed Application, loading save files, importing save files, and exporting save files. Altering, moving, copying, or removing these temporary folders or files may interfere with the functionality of the Launcher and the Licensed Application and could cause various issues such as loss of save data, among other issues. 

8.  The Launcher and Licensed Application do not collect or transmit personal or device-specific data.

However, data may be made available to us indirectly when You access external web resources through the Launcher, including but not limited to:

1.  Accessing the version code webpage through the Launcher’s update check function

2.  Opening our website or product pages (e.g., itch.io, sharp-set.com) via embedded Launcher links

3.  Accessing download pages or storefronts for updated versions of the Licensed Application (e.g., itch.io)

4.  Opening online policy documents (e.g., EULA, TOS, Privacy Policy) through Launcher links

These external Services (including websites and online storefronts) may collect personal or device data subject to their respective privacy policies. We do not control, and are not responsible for, data collection by third-party services. Data collected by our website is governed by our data policies. Please refer to our general Privacy Policy and the privacy terms of any applicable third-party services for more information.

This behavior is implemented solely to support proper functionality of the Licensed Application while respecting User privacy and system integrity.

You may opt out of any optional online functionality by:

1.  Ceasing use of and deleting the Launcher from Your device(s), and/or

2.  Choosing not to click or open any external links within the Launcher

We are not responsible for any accidental or unintended use of Launcher links, including selection or clicking of online features by the User or any third party.

4. USE OF YOUR INFORMATION

The device clock and limited storage access are only used locally on Your Device. No data is shared with us.

If personal data is made available to us through Services, it will be handled in accordance with our general Privacy Policy. Data made available by Services is strictly through such Services, and not through the storage or use of the Licensed Application.

No personal information or data is made available to us through the implementation of the Google Play Age Signals API.

4.1 INTRODUCTION POLICY AGREEMENT PROMPT

a.  The introduction of a new game (a new save) will prompt the User with an agreement window to confirm the User has read and agrees to the following policy documents for the Licensed Application: EULA, privacy policy, and terms of service. Each policy document's text in this agreement prompt contains a link to our website's associated webpage for each policy. The Licensed Application itself does not collect or transmit data or personal information. 

b.  Opening the links for the policy documents (listed above) during the introduction sequence for a new game will redirect the User to our dedicated webpages for these policies on our website. Our website may collect and use certain data and information during use; any data or information collected or accessed by our website is governed by our general website Privacy Policy. 

c.  Opening any of the links in the agreement prompt during the introduction (of the Licensed Application) is optional. Users may complete the agreement prompt during the introduction without opening any links to the policy webpages. 

d.  If the User does not want to utilize the linked webpages in the introduction agreement window, each policy document PDF is included in the download of the Licensed Application. Users may review these PDFs before starting a new game. 

e.  We are not responsible for any accidental or unintended use of agreement prompt links, including selection or clicking of online features by the User or any third party.

5. THIRD-PARTY ACCESS

Our Licensed Application does not use third-party analytics, advertising, or social media plugins. Your locally stored player data is not accessible to us.

We do not control or manage how Services handle Your data or information in relation to the purchase, download, use, or access to our Licensed Application. If You access, use, or download our Licensed Application through third-party Service websites, those Service websites may use Cookies or other forms of data collection or sharing that we do not control. Services may also use accounts to manage Your access or ability to purchase, download, or use the Licensed Application. We do not own or operate any such Service account functionality. 

We may have access to certain User data through these third-party Services, such as data related to the purchase, download, or use of our Licensed Application. Any access we may have through Services is strictly to facilitate distribution and related compliance for distribution of our Licensed Application through Services.

9. CONSENT

By using the Game Launcher and/or by running the Licensed Application and granting Device storage access, You consent to:

• The use of Google Play Age Signals API to verify Age Validation Signals to comply with regional regulations

• The use of Your Device storage for local saving, creation and deletion of required operation files and folders, and for the loading of Game data

• The inclusion of links to online webpages and any other online features of the Game Launcher or Licensed Application

Furthermore, You acknowledge that:

• All links or other online features of the Launcher or within the introduction agreement prompt are optional and not required in order to access, play, use, or store the Licensed Application or the Game Launcher or their related folders and files

• Google Play Age Signals API integration within our Licensed Application is a requirement in order to access the Google Play Version of our Licensed Application in regions with age verification laws until further notice.

10. WARRANTY

We do not warrant that the Licensed Application will function as intended in non-supported regions or on any on unsupported software or devices. You agree that we are exempt from privacy or data concerns for unsupported regions, software, or unsupported devices or operating systems, including and legal consequences that may arise from using or storing the Licensed Application on unsupported systems or use with unsupported software.

11. CHANGES TO THIS POLICY

We may update this Privacy Policy from time to time. Use or storage of the Licensed Application after any changes means that You accept the updated policy.

12. MISCELLANEOUS

The references of copyrights, trademarks, or other identifiers such as, "Google Play", "itch.io", "Steam", is solely for the purpose of illustrating terms of this Privacy Policy and services related. We do not claim ownership or management of these copyrights, intellectual properties, or platforms. All rights belong to the respective owners.
